8. DAMAGE IN TRANSIT, NON-RECEIPT, RETURNED GOODS
(i)All goods and materials shall be examined by the Purchaser on delivery. The Company shall not be liable for claims in respect of shortage or damage in transit unless the Carrier and the Company is notified in writing within three days of delivery or in the case of non-delivery notice in writing is given in respect thereof within fourteen days of the date of notice of dispatch of the Goods from the Works of the Company or its subcontractors. In the absence of written notice the Goods will be deemed to have been received in the correct quantity and free of defects, which would have been apparent on inspection.
(ii)Credit for shortage or damage will only be allowed when the Company's conditions in the preceding sub clause are met.
(iii)All Products are manufactured to the Purchasers specification as detailed in the purchasers order or instruction and the purchaser will not have any right to cancel the contract or return the products once delivered unless the product is defective or, if we in our absolute discretion, agree to cancel your order. Where we agree to cancel your Order we shall notify you in writing that the Contract between us has been cancelled and we shall be entitled to retain up to 25% (twenty five percent) of the purchase price for the Products paid by you or, where insufficient funds have been paid by you at the time of cancellation we may charge you for cancelling the Order in such amount as we shall in our sole discretion decide up to a maximum sum of 25% (twenty five percent) of the purchase price for the Product. The amount of any monies retained or charged by us under this condition shall be decided by us taking into account the losses and costs that we will reasonably suffer because of your cancellation up to
maximum amount of 25% (twenty five percent) of the purchase price.
Goods will only be accepted back for credit with the express permission of Locker Shop UK Ltd. Goods must be returned in their original packaging. Credit shall not be given for goods received damaged. The buyer shall unless otherwise stated be responsible for the cost of the return carriage of all goods returned which shall be at the risk of the buyer until actual receipt of the goods to the “the company”. Proof of return delivery will remain with the buyer. All items returned by pre-arrangement and found to contain no fault will be subject to a 25% re-stocking charge.
9. CANCELLATION
Cancellation will only be accepted by the Company on condition that the costs and expenses and the loss of profits and other loss or damage sustained by the Company (as to which in the absence of agreement between the Parties the Certificate of the Auditor of the Company shall be conclusive) will be reimbursed by the Purchaser to the Company forthwith.
